Scope of Agreement

These terms and conditions govern the sale of artwork (hereinafter referred to as "Artwork") by Marlien Kulsdom, hereinafter referred to as the "Artist," to the purchaser, hereinafter referred to as the "Buyer," under Dutch law.

Ordering Process

The Buyer may place an order for Artwork through the artist’s official website or designated platform. Orders are subject to availability, and the Artist reserves the right to refuse or cancel any order.

Payment

All prices are listed in euros and are exclusive of applicable taxes and shipping fees.

The Buyer agrees to pay the total amount specified at the time of purchase through the provided payment methods.

Delivery​

The Buyer is responsible for providing accurate shipping information.

Risk of loss and damage to the Artwork shall pass to the Buyer upon delivery. The Artist will make reasonable efforts to deliver the Artwork within the agreed timeframe.

Cancellation and Returns

Cancellations are only accepted within 24 hours of placing the order. Returns are accepted within 14 days of receiving the Artwork, provided it is in its original condition. The Buyer is responsible for return shipping costs.

​

Intellectual Property

Marlien Kulsdom retains all rights to the intellectual property of the Artwork, including copyright.

The Buyer may not reproduce, distribute, or create derivative works without the Artist’s explicit permission.

Custom Artwork

For custom orders, the Artist and the Buyer will agree upon the specifications, timeline, and pricing before commencing work. A non-refundable deposit may be required for custom orders.

Copyright and Reproduction

Marlien Kulsdom reserves the right to use images of the Artwork for promotional purposes, including but not limited to social media and portfolio display.

Limitation of Liability

Marlien Kulsdom is not liable for any indirect, incidental, or consequential damages arising out of the purchase or use of the Artwork.

​

Governing Law

This agreement is governed by Dutch law, and any disputes will be resolved through arbitration in accordance with the rules of the Dutch court.

Modifications

Marlien Kulsdom reserves the right to modify these terms and conditions at any time. Changes will be effective upon posting on her official website or platform.
